In order to comply with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, and applicable Guidelines (the “Law”), Sistemas Automatizados Allie, S.A. de C.V., its affiliates and/or subsidiaries, and/or related parties (“ALLIE”), with registered address at Bosques de Cidros No.18, 301-F3, Bosques de las Lomas, Cuajimalpa de Morelos, Mexico City, 05120 (the “Address”), electronic address: www.alliesystems.com (the “Site”), as the legitimate owner or authorized entity to commercialize and use the software known as Allie Systems (the “ALLIE Software”), for its use through web and other present and future digital platforms and web and/or mobile applications owned by ALLIE; and with the contact email hola@alliesystems.com (the “Email Address”), hereby makes available the following:

PRIVACY NOTICE

In order to provide legitimate, controlled, and informed treatment of your personal data—whether currently provided or supplied in the future—contained in our databases or collected through cookies or any other web-tracking technology, and to guarantee your privacy and right to informational self-determination, ALLIE is responsible for the use and protection of your personal data, which will be processed based on the principles of legality, consent, information, quality, purpose, loyalty, proportionality, and responsibility established in the Law.

USE OF INFORMATION

The information you provide through access, registration, and creation of a User profile on the Site and/or Platform, and/or via email, and/or by completing physical or electronic forms or surveys—whether in real-time or historical—will be processed and organized to generate data indicators that ALLIE may use to make business-relevant decisions. All collected information will be used for statistical purposes in a generic and non-personalized manner and will be associated with ALLIE’s growth, maintenance, and administration, always respecting your privacy.

These uses include internal operations and administration, communication with you, and fulfilling requests for services and/or products provided by ALLIE, as well as improving, developing, refining, and providing ALLIE’s services through its related parties, affiliates, authorized providers, and/or business partners. Appropriate measures will be established to limit the use of the information collected from you solely for legal and authorized purposes in accordance with this Notice, as well as with proper confidentiality and security measures.

ALLIE may also collect your IP (Internet Protocol) address to help diagnose issues with the ALLIE server and to administer the Site and the Platform. An IP address is a number assigned to your computer when connecting to the Internet. Your IP address may also be used to identify you within a particular session and to collect general demographic information.

ALLIE may use “push” technology through the application used to send notifications, with prior User authorization. This communication channel has no access to other functions or information on the device used to connect to the Site.

Information may include the URL you come from (whether on the Site or not), the URL you access next (whether on the Site or not), the browser you use, pages visited, searches performed, posts, commercial preferences, messages, etc.

USE OF COOKIES

ALLIE informs you that, through the use of cookies and similar technologies, it seeks to guarantee the best possible experience on the Site and/or the Platform by providing personalized information, remembering your service and marketing preferences, and helping you obtain the appropriate information.

USE OF THIRD-PARTY PLATFORMS AS A MEANS OF OBTAINING DATA

The Personal Data that ALLIE may request from you for commercial purposes or services—necessary for commercial proposals, pilot tests of the ALLIE Software, and for the overall operation, functionality, and troubleshooting of the ALLIE Software—may be collected through different means, such as:

  • Manual entry of information by the User on the Platform; or
  • Authorization to use data contained in platforms such as Google Inc., subject to the User’s prior registration of an email account on such platform; or
  • Through the use of third-party AI tools for customer support, such as Intercom R&D Unlimited Company, Intercom Inc., or any of their affiliates or subsidiaries (“Intercom”); or
  • Any other tool ALLIE considers useful for Platform purposes (individually or collectively, “Data Collection Platforms”).

To use Data Collection Platforms, User data is requested through ALLIE’s connection to the API (Application Programming Interfaces) integrated into the aforementioned Data Collection Platforms, and transmission of data will be subject to the terms and conditions stated in their respective privacy notices, including:

1. PERSONAL DATA REQUESTED

ALLIE, and/or its parent companies, affiliates, subsidiaries, related parties (“Related Parties”), and/or any third parties that—due to commercial relations with ALLIE—have contracted use of the Platform to complement their business proposal and need to process/use your personal data (the “Client”), and/or those who need to process/use your data due to the nature of their work as providers or business partners of ALLIE (“Business Partners”), request and obtain general personal data as well as personal data considered sensitive under the Law (“General Personal Data” and “Sensitive Personal Data,” collectively, “Personal Data”).

Sensitive Personal Data may be requested electronically or physically. Any physical information provided will be treated as if it were provided through the Site and/or Platform and will be governed by this document.

In all cases, the collection of Personal Data by ALLIE is carried out in good faith and for the purposes stated herein. Therefore, it is presumed that the data provided by its holders is truthful and complete, making the holder responsible for the accuracy of the data supplied.

A) CLIENTS AS PLATFORM USERS

The Personal Data collected from Clients using the Platform is necessary to document the commercial and legal relationship and to carry out the services contracted. Data voluntarily provided by you or your Administrators may be included in contracts, letters, forms, lists, databases, or other physical and/or electronic media as applicable.

The Personal Data requested includes:

General

  • Full name
  • Corporate landline and/or mobile number
  • Personal and corporate email
  • Address

Employment-related

  • Company name
  • Job title
  • Department
  • Number of direct reports
  • Corporate email
  • Phone number of direct supervisor

Organization

  • Legal name and corporate name
  • Trade name
  • Industry or sector
  • Tax ID (RFC)

B) CLIENT BUSINESS PARTNERS AS PLATFORM USERS

Personal Data collected from Business Partners consists of information necessary to document the process of use, selection, and registration within the Platform, as well as to fulfill internal policies, procedures, and legal obligations of ALLIE.

Data collected includes:

  • Name of individual or legal entity
  • Corporate address
  • Tax ID (RFC)
  • Landline and/or mobile number
  • Name and position of main contact
  • Corporate phone and/or mobile number of main contact
  • Corporate email of main contact
  • Banking information for deposits or electronic transfers
  • Any data required to process purchase orders or other documents within Platform modules

All Personal Data is processed by ALLIE and stored in a repository for treatment and transfer to the Client, in order to fulfill the Services acquired by the Client.

SINCE THE PLATFORM IS A DATA-PROCESSING TOOL PROVIDED TO THE CLIENT, WHICH ALLOWS MONITORING AND CENTRALIZATION OF ALL END-USER AND/OR BUSINESS PARTNER INFORMATION, ALLIE HAS NO CONTROL OVER THE CLIENT’S USE OR TRANSFER OF DATA. SUCH ACTIVITIES ARE GOVERNED BY THE CLIENT’S OWN PRIVACY NOTICE.

2. PURPOSES OF DATA PROCESSING

Personal Data provided through the Platform will be used for:

  • Processing data to create a record of Clients and the Service Modules used
  • Handling service requests made through the Site and/or Platform
  • Operating and providing the Services acquired by the Client and/or User
  • Providing advisory and follow-up to contracted Services
  • Allowing the Client to manage and monitor business relations with its Business Partners
  • Promotion and marketing of new products and/or services available on the Platform
  • Processing banking data for payment of purchase orders or commercial transactions through payment engines used by Clients

Once data processing purposes are fulfilled, and when not restricted by law, ALLIE may, at its discretion and with authorization from the Data Holder, use the collected data solely for statistical purposes in a generic, non-personalized manner, associated with ALLIE’s growth, maintenance, and administration, always respecting privacy.

3. TRANSFER

Personal Data may be transferred to:
(i) Related parties and/or business partners to enhance ALLIE’s value proposition or offer additional services;
(ii) Judicial authorities, Mexican or foreign, to comply with legal requirements;
(iii) Internet service providers hosting ALLIE’s technological infrastructure;
(iv) Technical support providers for the Platform.

ALLIE will ensure that any third party receiving Personal Data complies with appropriate administrative, technical, and physical security measures and uses Personal Data solely for the purposes outlined.

ALLIE will not transfer your Personal Data to unrelated third parties without prior consent, except as stated in this Notice or permitted by Law.

4. ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION, OPPOSITION)

You may request at any time the exercise of your ARCO rights:
(i) Access your data and details on processing;
(ii) Rectify inaccurate or incomplete data;
(iii) Cancel data when no longer necessary for stated purposes or when your relationship with ALLIE ends;
(iv) Object to data processing for specific purposes.

Requests must be submitted in writing to ALLIE or sent via the Email Address and include:
(a) Full name and address or contact method;
(b) Proof of identity or power of attorney;
(c) Clear description of the data in question;
(d) Any information facilitating data location.

5. REVOCATION OF CONSENT; LIMITATION OF USE AND DISCLOSURE

You may revoke consent or request limitation of data use/disclosure unless prohibited by law. Requests must follow the same procedure and requirements as ARCO requests.

ALLIE will respond within the timeframes established by Law.

If your data was previously transferred and is still being processed by ALLIE’s processors, ALLIE will notify them of the revocation.

6. CHANGES TO THE PRIVACY NOTICE

ALLIE reserves the right to modify or update this Privacy Notice at its discretion. Changes will be communicated through the Site and/or Platform and, when applicable, through internal networks, electronic or physical notices, or written notification to your email.

7. DIGITAL, ELECTRONIC, OR ONLINE FORMAT

The Parties agree that the agreement may be formalized digitally, electronically, or online, and that expressing consent and providing personal data through the ALLIE Site is sufficient without requiring a physical signature.
